- Sexual immorality in private life is a major misconduct if it tarnished the company’s name.
- Accident is not a misconduct even though if it caused damage to the company.
- “Scold your staff with a smile on your face”. Employee can claim for constructive dismissal if you use abusive words or verbal harassment or threatening them to resign. Bare in mind to be careful with what you say or do because employee has the right to challenge every single move you make.
- Remaining absent without applying for leave is better than being absent after your leave has been rejected. Being absent after your leave has been rejected is a major misconduct.
- Employee must carry out any instruction given by the superior even though it is unlawful or illegal. Discuss, put in writing, highlight the issue that is not right and the implication of doing so and conclude by writing ‘I will do it as per instruction’. This is to safe guard yourself. If an employee disobeys the instruction, it is a major misconduct.
